Spain’s golden visa is closed: what you can still get, and what agents are still selling

You have been quoted a price for a Spanish golden visa in 2026. Stop before you pay it. Spain shut the investor residence visa to new applicants on 3 April 2025 under Organic Law 1/2025. Files lodged before that date are still being processed and existing holders can renew, but nobody can enter the programme today — not through property, bonds, a deposit or a business. Buying Spanish property remains perfectly legal; it simply comes with no visa attached. What Spain does still offer is a set of residence routes for people who will genuinely live there. This page separates the two so you make the right call.

Non-lucrative visa

Where families lose money and years

The 2026 golden-visa advert

Some agencies still market a Spanish golden visa. Whatever they call it, no new investor application by property, bonds, deposit or business investment has been possible since 3 April 2025. Ask them for the legal basis; there is none.

The €500,000 flat with no permit

Buying property is legal, and some buyers are told the permit will follow. It will not. The flat is a flat. If your goal was residence, you have spent the money on the wrong thing.

Living in Spain while staying Indian for tax

The non-lucrative visa requires you to actually live in Spain, and more than 183 days there makes you a Spanish tax resident. There is no version of this where you keep Indian tax residence and enjoy Spain full time.

Treating the nomad visa as a work permit

The digital nomad visa is for work done for non-Spanish clients and employers. It is not permission to take Spanish clients or a Spanish job.

The India side nobody explains

Passive income must show on your Indian returns

For the non-lucrative visa, the roughly €28,800 a year is proven from Indian sources — rent, dividends, pension, interest — through tax returns and bank statements. Income that is real but undeclared does not exist for the consulate. We read your last returns with you before you decide.

Living there means Spanish tax residence

Spend more than 183 days in Spain and you become a Spanish tax resident. Your Indian income is then taxed in Spain, with credit under the India–Spain tax treaty. Families who imagine keeping Indian tax residency while living in Valencia are planning something the rules do not allow. This is a chartered-accountant conversation before you apply.

LRS still governs the money

Whether you buy a Spanish home or fund living costs, remittances run under the RBI’s Liberalised Remittance Scheme at US$250,000 per person per financial year, with property coded S0005. From 1 April 2026, amounts above ₹10 lakh in a year for investment purposes carry 20% TCS, adjustable or refundable through your return. Any Spanish asset is then disclosed in Schedule FA.

Questions people ask us about Spain Golden Visa

  • Not as a new applicant. The programme closed on 3 April 2025 under Organic Law 1/2025. Only applications lodged before that date are still processed, and only existing holders can renew.

  • No. Property ownership in Spain is legal for Indians but carries no visa. You would enter as a visitor under the normal Schengen rules or apply for one of the residence routes on this page.

  • Nothing in Spain replicates it. The non-lucrative visa suits people with passive income, but it requires actually living in Spain and becoming a Spanish tax resident. If you want a permit you can hold while living in India, look at Portugal, Greece or Latvia.

  • Roughly €28,800 a year for the main applicant, which is 400% of the IPREM index, plus about €7,200 for each dependant. It is granted for one year and then renewed in two-year blocks.

  • If your employer or clients are outside Spain and the work can be done remotely, yes in principle. Income needs to be around €2,762 a month on 2025 figures, with more for dependants, and the visa runs up to three years before renewal.

  • Above 183 days in Spain you are a Spanish tax resident, so Indian rent, dividends and other income are taxed in Spain with credit under the India–Spain treaty. Your CA should model this before you apply, not after your first Spanish tax year.

  • Permanent residence after five years of legal residence, and citizenship after ten years for Indian nationals. Both depend on actually living in Spain through those years.
